1. About Digital Traffiq

Depending on the service selected, our offerings may include digital marketing strategy, social media marketing, search engine optimisation (SEO), paid advertising, lead generation, lead nurturing, email marketing, WhatsApp marketing and automation, CRM and lead management, chatbots, workflow automation, analytics, reporting, content marketing and other related services.
2. Eligibility
You must have the legal capacity to enter into a binding agreement under applicable law to purchase or use our services.
If you are purchasing or using our services on behalf of a company, organisation or other entity, you confirm that you have the authority to bind that entity to these Terms.
3. Services
Digital Traffiq will provide the services described in the applicable quotation, proposal, service package, statement of work, invoice, subscription or other written communication agreed with the client.
The scope, deliverables, timelines, campaign requirements and other service conditions may vary depending on the service package selected.
3.1 Service Scope
Any additional work requested outside the agreed scope may be subject to additional charges and timelines. Such additional work will be undertaken only after the applicable requirements and charges are communicated to and accepted by the client.
3.2 Service Availability
We will make reasonable efforts to provide services within the agreed timelines. However, timelines may be affected by factors including delayed approvals, unavailable information, third-party platforms, technical issues, advertising platform reviews, policy restrictions, changes in platform algorithms, or circumstances outside our reasonable control.
4. Client Responsibilities
To enable Digital Traffiq to provide the services effectively, the client agrees to provide accurate, complete and timely information, access and approvals reasonably required for the project.
The client may be required to provide:
- Business and company information
- Brand assets, logos, images and other approved materials
- Website and social media access where required
- Advertising account access where applicable
- CRM or marketing platform access where applicable
- Product, service and pricing information
- Content, offers and promotional information
- Required approvals and feedback
- Accurate lead or customer information where applicable
Delays caused by failure to provide required information, access, approvals or feedback may result in corresponding changes to delivery timelines.
5. Digital Marketing and Advertising Disclaimer
Digital marketing results depend on various factors, including market conditions, competition, advertising budgets, audience behaviour, product or service quality, pricing, website performance, sales processes, platform algorithms and other factors outside our control.
Any performance estimates, projections, case studies or examples shared by Digital Traffiq are for informational purposes and should not be interpreted as a guarantee of future results.
6. Advertising Platforms and Third-Party Services
Some Digital Traffiq services may depend on third-party platforms such as Meta, Google, WhatsApp, email service providers, CRM platforms, hosting providers, analytics tools, automation platforms and other third-party services.
Digital Traffiq does not control third-party platforms and cannot guarantee their availability, functionality, policies, approval decisions, pricing, algorithm changes or continued operation.
Changes, restrictions, suspensions or termination imposed by a third-party platform will not automatically constitute a failure by Digital Traffiq to provide its services.
7. Advertising Budget
Unless specifically stated otherwise in writing, advertising media spend paid to platforms such as Meta or Google is separate from Digital Traffiq's professional service fees.
The client is responsible for maintaining sufficient advertising budget and valid payment methods in the applicable advertising account.
8. Payments and Billing
Service fees are payable according to the payment schedule, quotation, proposal, invoice or subscription terms agreed with the client.
Payments may be made through authorised payment methods available on our website, including third-party payment gateways such as Razorpay.
8.1 Payment Confirmation
A payment is considered received once the transaction has been successfully confirmed by the applicable payment processor and the payment is reflected as received by Digital Traffiq.
8.2 Taxes
Applicable taxes, duties or government charges may be added to service fees where required by applicable law.
8.3 Failed Transactions
If a payment fails, is declined, reversed or remains incomplete, Digital Traffiq may require the client to complete the payment before commencing or continuing the relevant services.
9. Refunds and Cancellations
Refunds and cancellations are governed by our separate Refund & Cancellation Policy available on our website.
Because many of our services involve customised strategy, campaign setup, content creation, automation configuration, technical work and other professional services, eligibility for a refund may depend on whether work has already commenced or deliverables have already been provided.

10. Intellectual Property
Unless otherwise agreed in writing, Digital Traffiq retains ownership of its pre-existing methodologies, processes, templates, frameworks, systems, tools, know-how, automation structures and proprietary materials.
Upon receipt of full payment, the client may receive rights to use specifically approved final deliverables created for the client, subject to any third-party licences or restrictions applicable to those materials.
Third-party assets, fonts, stock images, software, plugins, platforms, APIs and other licensed materials remain subject to their respective owners' licence terms.
11. Client-Provided Materials
The client represents that it has the necessary rights, permissions and licences to provide any content, images, logos, videos, customer data, trademarks, documents or other materials supplied to Digital Traffiq.
The client is responsible for ensuring that such materials do not infringe the intellectual property, privacy or other rights of any third party.
12. Lead Data and Customer Information
Where Digital Traffiq provides lead generation, CRM, WhatsApp, email marketing, chatbot or automation services, the client remains responsible for the legality and accuracy of the customer or lead information supplied to us or collected through the client's campaigns.
The client must ensure that appropriate permissions, notices and consents are obtained where required under applicable laws and the policies of relevant communication platforms.
13. Prohibited Use
You agree not to use our website, services, systems or related resources for unlawful, fraudulent, abusive or malicious purposes.
This includes, but is not limited to:
- Fraudulent activities
- Spam or abusive communications
- Phishing or impersonation
- Distribution of unlawful content
- Activities that violate applicable laws
- Activities that violate third-party platform policies
- Unauthorised access to systems or accounts
- Distribution of malicious software
- Misuse of personal or customer information
14. Confidentiality
Both parties agree to use reasonable measures to protect confidential business, technical, financial and operational information received from the other party in connection with the services.
Confidential information does not include information that is publicly available, independently developed, lawfully received from another source, or required to be disclosed by law or legal authority.
15. Website Content

16. Website Availability

18. Force Majeure
Digital Traffiq shall not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, telecommunications failures, cyber incidents, third-party service outages, platform restrictions, labour disruptions or other unforeseen events.
19. Suspension or Termination
Digital Traffiq may suspend or terminate services where the client:
- Fails to make required payments
- Provides false or misleading information
- Uses the services for unlawful purposes
- Violates these Terms
- Violates applicable third-party platform policies
- Engages in abusive or threatening behaviour toward our team
Termination or suspension does not automatically waive any outstanding payment obligations incurred before termination.
20. Third-Party Links and Services
Our website or services may contain links, integrations or references to third-party websites, applications and services.
Digital Traffiq does not control and is not responsible for the availability, content, security, privacy practices, policies or performance of third-party services.
21. Privacy
